TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using the Upstream Tycoon platform — operated by AITEKS SOLUCOES EM TECNOLOGIA LTDA (CNPJ 57.420.480/0001-67) — you confirm that you have read, understood, and agreed to these Terms of Service. If you do not agree, do not use the services.

2. Description of Services

Upstream Tycoon is a suite of educational upstream oil & gas simulators (Engineering Edition, Drilling Edition, CO2 Storage Edition). Services include in-browser gameplay, cloud save sync, global leaderboards, and user account features.

3. Account Registration

• You are responsible for maintaining the confidentiality of your login credentials.
• Creating accounts on behalf of others without authorization is prohibited.
• Notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

By using the platform you agree not to:

• Violate any applicable laws or regulations.
• Attempt to access systems, accounts, or data of other users without authorization.
• Reverse engineer, decompile, or modify the platform code for unauthorized purposes.
• Use automated scripts or bots to manipulate leaderboard scores or game data.
• Post or transmit content that is offensive, defamatory, or infringes third-party rights.

5. Intellectual Property

All platform content — including code, graphics, game mechanics, text, and trademarks — is the exclusive property of Aiteks or its licensors, protected by Brazilian and international intellectual property law. You are granted a personal, non-transferable, non-exclusive license to use the platform for educational and entertainment purposes only.

6. Game Data and Progress

Game progress is saved locally in your browser (localStorage) and, if you are logged in, synced to our servers. Aiteks does not guarantee the permanent availability of cloud save data and recommends keeping local backups using the in-game export feature.

7. Service Availability

We make reasonable efforts to keep the platform available but do not guarantee uninterrupted access. We may suspend the service temporarily for maintenance or updates without prior notice.

8. Limitation of Liability

To the maximum extent permitted by law, Aiteks is not liable for indirect, incidental, special, or consequential damages arising from the use of or inability to use the platform. Our total liability shall not exceed any amounts you paid in the preceding 12 months.

9. Privacy

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

10. Changes to These Terms

We may revise these Terms at any time. Registered users will be notified of material changes by email or in-platform notice. Continued use after publication constitutes acceptance of the revised Terms.

11. Termination

You may close your account at any time. Aiteks may suspend or terminate access immediately for violations of these Terms, without prejudice to any other remedies available.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Aiteks's registered domicile shall have exclusive jurisdiction over any disputes arising from these Terms.
